MINUTES OF THE REGULAR COUNCIL MEETING
The Regular Meeting of the Council of the Corporation of the Township of Assiginack was held in the Council Chambers on Tuesday, July 7, 2015 at 7:00 P.M.
Present: Reeve Paul Moffatt, Councillor Robert Case, Councillor Leslie Fields, Councillor Hugh Moggy, Councillor Brenda Reid

OPENING:

THAT the Regular Meeting of the Council of the Corporation of the Township of Assiginack be opened for business with a quorum of members present at 7:00 p.m., with Reeve Moffatt presiding in the Chair. CARRIED
AGENDA:

THAT the agenda for this meeting be amended by removing item 7-E Donation Request: Southeast Manitoulin Lion’s Club;
AND THAT the agenda be accepted as amended. CARRIED
DISCLOSURE OF PECUNIARY INTEREST:
Councillor Reid disclosed a direct pecuniary interest in Agenda Item 7A Payroll as her husband is an employee of the Township. She did not take part in any discussion, attempt to influence the vote or vote on the matter.
PUBLIC MEETING UNDER AUTHORITY OF PLANNING ACT

THAT we adjourn from our Regular Meeting and Open a Public Meeting for the purpose of hearing comments on a proposed amendment to By-law #80-21, being a by-law to regulate the use of land in the Town of Manitowaning, with Reeve Moffatt presiding in the Chair. CARRIED

THAT Council authorizes the following Accounts for Payment:
General: $368,348.00
AND THAT the Reeve and administration be authorized to complete cheques #24463 through #24498 and cheques #24527 through #24569 as described in the attached cheque register reports. CARRIED

THAT Council authorizes the following Accounts for Payment:

THAT WHEREAS the Council of the Corporation of the Township of Assiginack has received the following responses to Tender No. 2015-02: Winter Sand and Aggregates;
Mike Varey Excavating $55,977.94
Calvin Pearson & Sons Excavating $53,510.02
Don Eadie Construction $55,031.00
NOW THEREFORE THAT the tender of Calvin Pearson & Sons Excavating be accepted and staff be instructed to contact all parties and inform them of the results. CARRIED

THAT the Council of the Corporation of the Township of Assiginack has received the Monthly Budget Review – Actual vs. Budget Comparison at as May 31, 2015. CARRIED

THAT Council approves the temporary road closure of Queen Street, between the intersections of Spragge Street and Arthur Street on August 8, 2015 from 5 p.m. to 2 a.m. on August 9th, in order to facilitate a wedding. DEFEATED

THAT Council approves the following Lottery Licence subject to the application submitted:
1) Southeast Manitoulin Lion’s Club – 50/50 Raffle – July 19, 2015. CARRIED

THAT WHEREAS Council adopted By-law 09-21 on June 21, 2009 being a Recyclables Acceptance Agreement with the City of Sudbury;
AND WHEREAS the original agreement calls for the amendment of Schedule “C” – Processing Rates, from time to time;
NOW THEREFORE THAT Council approves the Schedule “C” amendment to the Recyclables Acceptance Agreement with the City of Greater Sudbury, which increases the processing rate by the annual cost index increase to $98.69 per tonne of Recyclables accepted. CARRIED

THAT WHEREAS the Rogers Creek Bridge is found on a boundary road with the Township of Tehkummah;
AND WHEREAS Gary MacKay, a Professional Engineer from Tulloch Engineering was contracted to inspect the Roger’s Creek Bridge according to the Ontario Structure Inspection Manual under O. Reg 104/97;
AND WHEREAS the results of the inspection report prove that the bridge is in a state of disrepair and deteriorating to the point that action is required and the continuing safety of those using the bridge cannot be guaranteed;
THEREFORE BE IT RESOLVED THAT based on the recommendation of the Engineer that Council instructs staff to take the necessary steps to implement the temporary closure of Roger’s Creek Bridge and to search for funding for a long-term solution;
AND FURTHER THAT we notify the Council of the Township of Tehkummah of our actions and request that they take similar steps to adopt a similar resolution as soon as possible. CARRIED

THAT By-law No. 15-20, being a by-law to authorize billing and collection of water and wastewater services for Manitowaning and Sunsite Estates be given its third and final reading and enacted in open Council. CARRIED
ANNOUNCEMENTS:
Staff entertained two questions from Councillor Moggy. Councillor Fields commended Jackie White, Ron Cooper and the Public Works Staff for all of the work that has been done at the public beach, for which she has received many positive comments.
The Clerk announced that the Service Line Warranty Program which was approved by Council did not send a Spring information package to any of the residents of the municipalities who also approved this program due to problems acquiring Canadian names and addresses. They are currently examining the legal implications of getting a list of water users from the Township, in terms of the Municipal Freedom of Information and Protection of Privacy Act. This is expected to be resolved in time for the Fall mail campaign. In the meantime, Manitowaning and Sunsite Estates water users are welcome to sign up for the insurance program through the Service Line Warranties of Canada website or toll free phone number. www.slwofc.ca or 1-866-922-9004
