MINUTES OF THE REGULAR COUNCIL MEETING

 

The Regular Meeting of the Council of the Corporation of the Township of Assiginack was held in the Council Chambers on Tuesday, August 18th, 2015 at 5:00 P.M.

 

Present: Mayor Paul Moffatt, Councillor Robert Case, Councillor Leslie Fields, Councillor Hugh Moggy, Councillor Brenda Reid

OPENING:

THAT the Regular Meeting of the Council of the Corporation of the Township of Assiginack be opened for business with a quorum of members present at 5:00 p.m., with Mayor Moffatt presiding in the Chair. CARRIED

 

AGENDA:

#287-19-15      H. Moggy – R. Case

THAT the agenda for this meeting be amended by adding the following items:

3A) Residents of Michael’s Bay Road Petition

6J) War Pensioners of Canada: Highway 6 Name Change

7E) Town of NEMI Notice of Open House: New Official Plan

AND THAT the agenda be accepted as amended. CARRIED

 

DISCLOSURE OF PECUNIARY INTEREST:

Councillor Reid disclosed a direct pecuniary interest in Agenda Item 6A Payroll as her husband is an employee of the Township.  She did not take part in any discussion, attempt to influence the vote or vote on the matter.

 

ADOPTION OF MINUTES:

THAT the Minutes of the August 4th, 2015 Regular Council Meeting be accepted. CARRIED

THAT the Minutes of the July 28th, 2015 Manitoulin Planning Board Meeting be accepted. CARRIED

THAT the Minutes of the August 10th, 2015 Manitoulin East Municipal Airport Commission Meeting be accepted. CARRIED

 

DELEGATIONS

THAT we thank Louise Begin for making her delegation to Council on behalf of the residents of Michael’s Bay Road. CARRIED

 

REPORTS

THAT Council accepts the Staff Report titled, “2015-16 Arena Ice Rental Rates”;

AND THAT the recommendations be approved and implemented for the 2015-16 operating season. CARRIED

 

ACTION REQUIRED ITEMS:

THAT Council authorizes the following Accounts for Payment:

General:            $109,504.16

AND THAT the Mayor and administration be authorized to complete cheques #24695 through #24718 as described in the attached cheque register report. CARRIED

THAT Council authorizes the following Accounts for Payment:

Payroll:             $16,695.88

Direct Deposit:             $9,796.34

AND THAT the Mayor and administration be authorized to complete cheques #24679 through #24694 as described in the attached cheque register reports. CARRIED

THAT Council authorizes the extension of the Roadside Parks & Waste Removal Contract with Barry Foisy (Windows Unlimited) based on a price freeze for 2016 through 2018. DEFEATED

 

#296-19-15      R. Case – H Moggy

WHEREAS Perth-Wellington MPP, Randy Pettapiece, plans to introduce a private member’s resolution regarding the fairness of provincial infrastructure funds;

AND WHEREAS there is a perception that public infrastructure dollars have, in at least some cases, been directed according to politics and not according to need;

AND WHEREAS all Ontario municipalities, especially those in the North, rely on infrastructure funding to complete critical projects;

AND WHEREAS funding applications should be considered based on well-defined and transparent criteria and granted based on need and not the political stripe of our riding;

NOW THEREFORE THAT the Council of the Corporation of the Township of Assiginack formally supports the private member resolution of Randy Pettapiece regarding fairness in provincial infrastructure funding. CARRIED

 

#297-19-15      H. Moggy – R. Case

WHEREAS Algoma-Manitoulin MPP, Michael Mantha has written a letter to the Minister of Transportation questioning the discontinuation of the Senior Driving Education Program in the Town of Gore Bay and other locations on Manitoulin Island;

AND WHEREAS residents of Manitoulin, especially seniors, are already forced to travel within Manitoulin and beyond in most cases, to receive other types of programming;

AND WHEREAS our seniors should not have to travel a great distance to receive the Senior Driving Education Program, this program should come to them, in the community where they reside;

AND WHEREAS a valid justification for cancelling the program has not been given by the Ministry of Transportation;

NOW THEREFORE THAT the Council of the Corporation of the Township of Assiginack supports the letter sent to the Minister of Transportation by MPP Michael Mantha and that a letter of support from Council be sent to Minister Del Duca, Michael Mantha, and the Town of Gore Bay. CARRIED

 

#298-19-15      B. Reid – L. Fields

THAT Council approves the donation of 15 hours of ice-time to the Manitowaning Minor Hockey Association for the Pro-Tech Hockey Camp. CARRIED

THAT Council instructs staff to prepare a survey for public consultation on the options for the Canada 150th Anniversary grant opportunity;

AND THAT the survey be available online and in hard-copy and the approved cost limit for this task is $280. CARRIED

THAT Council approves the Application for Tile Loan in the amount of $30,000 subject to the application being approved by the Ontario Ministry of Agriculture, Food and Rural Affairs. CARRIED

THAT Council approves the preliminary engineering study for the Manitowaning Lagoon as proposed by OCWA to determine potential energy savings;

AND THAT Staff instruct OCWA to provide Council with a proposal to have an infiltration evaluation of the waste water system provided. CARRIED

THAT Council approves the proposal from Exp Services Inc. in the amount of $3,677.50 to perform caffeine testing of the water at the Manitowaning Lagoon. CARRIED

 

#303-19-15      L. Fields – B. Reid

THAT we instruct staff to inform the Manitoulin Planning Board that Assiginack Council does not have any objections to the application for amendment to zoning by-law 2002-32, File No. 2-32ZBL-15-001. CARRIED

THAT Council supports the letter from Colin Pick of War Pensioners of Canada, Inc., to change the name of the portion of Highway 6 that runs through the Township of Assiginack to “Veterans Memorial Highway #6.” CARRIED

BY-LAWS:

THAT By-law #15-24, being a by-law to adopt a policy for private road signage be given its first and second readings. CARRIED

 

#307-19-15      L. Fields – B. Reid

THAT By-law #15-24, being a by-law to adopt a policy for private road signage be given its third and final reading and enacted in open Council. CARRIED

 

ANNOUNCEMENTS:

Councillor Fields thanked Ron Cooper and his staff for clearing more roadside grass and bushes by the Information Booth on the highway, visibility is much better in that area now.  She enquired with staff why the MMA minutes have not been included in Council packages. Staff explained that there has only been one meeting this year and the minutes have not been received but they will be included in the Council package going forward.

Councillor Moggy had a call from a ratepayer in Sunsite Estates about a tree on Township property that is in danger of falling.  Staff has hired a professional to take this tree down.  He also asked about a 911 sign change request that has not been completed and wondered if the wrong sign was changed by mistake.  Staff will look into the specifics and get the sign changed as requested.

 

CLOSED SESSION

THAT in accordance with By-law #02-02 as amended and Section 239 of the Municipal Act as amended Council proceeds to a “Closed Session (in-camera)” at 5:39 p.m. in order to attend to matters pertaining to:

  1. a) The security of the property of the Municipality (1 item)
  2. b) Personal matters about an identifiable individual (1 item)
  3. f) Advice that is subject to solicitor-client privilege (2 items). CARRIED

THAT we adjourn from our Closed Session at 6:40 p.m., approve the minutes of the Closed Session of June 16th, 2015 and resume our Regular meeting. CARRIED

THAT Council has received the engineers report on the Rogers Creek Bridge;

AND THAT Council has examined all of the options and due to previous budget commitments, cost, and traffic usage no action will be taken for this term of Council. CARRIED
