MINUTES OF THE SPECIAL COUNCIL MEETING

The Special Meeting of the Council of the Corporation of the Township of Assiginack was held in the Council Chambers on Monday, November 28, 2022, at 5:00 pm.

OPENING:

THAT the Special Meeting of the Council of the Corporation of the Township of Assiginack be opened for business at 5:00 pm, with a quorum of members present, with Mayor Reid presiding in the Chair. CARRIED

 

AGENDA:

THAT the agenda for this meeting be amended by adding 6j) Leask Bay Shores Lane Maintenance Agreement and 6k) Christmas Bonuses. CARRIED

 

DISCLOSURE OF PECUNIARY INTEREST:

Councillor J. Hooper disclosed a direct pecuniary interest in agenda item 6a) Canada Post Lease, and did not participate in the discussion, attempt to influence the vote or vote on the matter.

 

ANNOUNCEMENTS:

Council agreed that it would begin each meeting with the following land acknowledgement:
We acknowledge that we are meeting in the traditional territory of the Potawatomi, Ojibwe and Odawa peoples of Mnidoo Mnising.

ACTION REQUIRED ITEMS:

THAT we inform Canada Post that we are requesting a lease increase of 8% to reflect the anticipated inflation rates for the duration of the requested lease extension. CARRIED

THAT we instruct Staff to prepare a sales tender of the Clover Valley School, in its current condition and to contain a minimum bid of $70,000.00 (Seventy Thousand Dollars). CARRIED

THAT we instruct Staff to consult with the Department of National Defence to secure a decommissioned field piece for display in our Cenotaph;

AND THAT we confirm that any work, alteration, addition or removal from the Cenotaph must first be approved by Council in writing. CARRIED

THAT we inform Hydro One that we will consider allowing submarine cables to be buried on the shore road allowances under the following conditions:
a) Hydro One enters into a formal easement for each individual service, complete with a detailed description of the location of each line with a site plan, suitable for registering on title.
b) Hydro One assumes all liabilities for all installations, in writing, in a form acceptable to the municipality’s Solicitor.
c) Hydro One agrees to repair or make safe any such installation that is exposed to the elements, as an immediate priority. CARRIED

THAT we tender for design and costs for the Assiginack Arts and Entertainment Centre. CARRIED

THAT we inform the Steamship Society that we will require their final proposal to remove the Norisle for Council’s consideration by April 28, 2023;

AND THAT we inform them that we will be investigating all other options for removal of the vessel as well. CARRIED

THAT we confirm our Ministerial Delegation Requests during the Annual ROMA conference as follows:
a) Aggregate Resources Act impact on Ratepayers
b) Water, Wastewater System Financial Viability
c) Disposition of the Manitowaning OPP Station

THAT we inform JL Richards that we will not be proceeding with the conceptual plans or updating costs from the waterfront upgrading proposal from 2001 at this time. CARRIED

THAT we request Public Works to confirm a price to proceed with the installation of am MTO Standard streetlight at the intersection of Sucker Lake Road and Highway #6 for the consideration in the 2023 Capital Budget. CARRIED

THAT we inform the South Bay Cottagers Association that we will not be continuing with the Leask Bay Shores Lane Maintenance Agreement, until such time as the Association has all landowners on which the right of way crosses on board with the Association’s request for municipal maintenance. CARRIED

THAT we issue Christmas Bonuses in the amount of $200.00 to each full-time employee and $100.00 to each part time or seasonal employee. CARRIED

BY-LAWS:

BE IT RESOLVED THAT By-law # 2022-23, being a by-law to appoint an Integrity Commissioner be given, first, second, third and final readings and enacted in open Council. CARRIED

 

#290-21-2022 J. Bowerman – R. Maguire
BE IT RESOLVED THAT By-law # 2022-07, being a by-law to regulate short term rentals be given third and final reading and enacted in open Council. CARRIED

 

CLOSED SESSION:

BE IT RESOLVED THAT in accordance with By-law # 02-02 as amended, and Section 239 of the Municipal Act, as amended, Council proceed to a Closed Session at 6:05 p.m. in order to attend to a matters pertaining to:
a) Personal matters about an identifiable individual, including municipal or local board employees (2 matters)
b) A proposed or pending acquisition or disposal of land by the Municipality, (OPP Station) and
c) Litigation, potential litigation including matters before administrative tribunals. (Slip and Fall Settlement)
