MINUTES OF THE REGULAR COUNCIL MEETING

 

The Regular Meeting of the Council of the Corporation of the Township of Assiginack was held in the Council Chambers on Tuesday, November 17th, 2015 at 5:00 p.m.

 

Present: Mayor Paul Moffatt, Councillor Robert Case, Councillor Leslie Fields, Councillor Hugh Moggy, Councillor Brenda Reid

Staff: Alton Hobbs, CAO, Jeremy Rody, Clerk, Jackie White, PEC, Ron Cooper, PW Superintendent

OPENING:

THAT the Regular Meeting of the Council of the Corporation of the Township of Assiginack be opened for business with a quorum of members present at 5:00 p.m., with Mayor Moffatt presiding in the Chair. CARRIED

 

AGENDA:

#397-26-15      L. Fields – H. Moggy

THAT the agenda for this meeting be amended by adding the following items:

4-A) Personal matters about an identifiable individual: Staff (Municipal Act, 2001, c.25 s. 239 (2) (b));

6-C) Tender #2015-04: Sale of Surplus Equipment;

AND THAT the agenda be accepted as amended. CARRIED

 

DISCLOSURE OF PECUNIARY INTEREST:

Councillor Reid disclosed a direct pecuniary interest in Agenda Item 6A Payroll as her husband is an employee of the Township.  She did not take part in any discussion, attempt to influence the vote or vote on the matter.

Councillor Case disclosed a direct pecuniary interest in Agenda Item 6A General as he was paid for his horse and wagon services during the Pumpkin Festival.  He did not take part in any discussion, attempt to influence the vote or vote on the matter.

 

ADOPTION OF MINUTES:

THAT the Minutes of the November 3rd, 2015 Regular Council meeting be accepted. CARRIED

THAT the Minutes of the November 2nd, 2015 Manitoulin East Municipal Airport Commission meeting be accepted. CARRIED

THAT the minutes of the Sudbury and District Board of Health meeting of October 15th, 2015 be received. CARRIED

 

ACTION REQUIRED ITEMS:

THAT Council authorizes the following Accounts for Payment:

General:            $91,629.12

AND THAT the Mayor and administration be authorized to complete cheques #24973 through #25009 as described in the attached cheque register reports. CARRIED

THAT Council authorizes the following Accounts for Payment:

Payroll: $17,765.84

AND THAT the Mayor and administration be authorized to complete cheques #24968 through #24972 as described in the attached cheque register reports. CARRIED

THAT Assiginack Council confirms a $3,000 contribution to the Manitoulin Health Centre for Physician Recruitment will be included in the 2016 Budget. CARRIED

THAT WHEREAS the Council of the Township of Assiginack has received the following responses to Tender No. 2015-04: Sale of Surplus Equipment pursuant to the attached schedule;

NOW THEREFORE THAT the tender of John Ham in the amount of $2,000.00 be accepted for Item #1, the tender of Brian Willoughby in the amount of $85.88 be accepted for Item #2, the tender of Marc Hovingh in the amount of $621.50 be accepted for Item #3;

AND FURTHER THAT staff be instructed to contact all parties and inform them of the results. CARRIED

BY-LAWS:

THAT By-law #15-29, being a by-law to adopt a code of conduct policy for Council Members and local boards be given its third and final reading and enacted in open Council. CARRIED

 

#407-26-15      B. Reid – R. Case

THAT By-law #15-30, being a by-law to govern the proceedings of Council and Committees and Boards of Council be given its third and final reading and enacted in open Council. CARRIED

THAT By-law #15-32, being a by-law to require the erection and maintenance of fences and gates around swimming pools and hot tubs be given its first and second readings. CARRIED

THAT By-law #15-32, being a by-law to require the erection and maintenance of fences and gates around swimming pools and hot tubs be given its third and final reading and enacted in open Council. CARRIED

THAT By-law #15-33, being a by-law to amend by-law #12-19: Fire and Emergency Services be given its first and second readings. CARRIED

THAT By-law #15-33, being a by-law to amend by-law #12-19: Fire and Emergency Services be given its third and final reading and enacted in open Council. CARRIED

THAT By-law #15-34, being a by-law to amend the Township’s Municipal Alcohol Policy as amended, established by by-law #14-02 be given its first and second readings. CARRIED

THAT By-law #15-34, being a by-law to amend the Township’s Municipal Alcohol Policy as amended, established by by-law #14-02 be given its third and final reading and enacted in open Council. CARRIED

THAT By-law #15-35, being a by-law to establish a Strategic Planning Committee and adopt Terms of Reference for the committee be given its first and second readings. CARRIED

THAT By-law #15-35, being a by-law to establish a Strategic Planning Committee and adopt Terms of Reference for the committee be given its third and final reading and enacted in open Council. CARRIED

 

ANNOUNCEMENTS & INQUIRIES:

Councillor Reid requested that Council approach the local committee that has been involved in bringing a refugee family to Manitowaning.  Council had agreed at an earlier meeting that they would keep their donations for the refugee crisis local.  Council agreed, and the committee will be contacted regarding a donation from Assiginack Council.

Councillor Moggy requested that Staff have a professional engineer inspect the Fire Hall to find out where the water is coming in the building and causing a mold issue.  The CAO responded that an engineer has looked at the building and is preparing a report for Council.

THAT in accordance with By-law #02-02 as amended and Section 239 of the Municipal Act as amended, Council proceeds to a “Closed Session (in-camera)” at 5:21 p.m. in order to attend to a matter pertaining to:

THAT we adjourn from our Closed Session at 5:26 p.m., approve the minutes of the Closed Session of October 20th, 2015 and resume our regular meeting.  CARRIED
